What is an outsourced compliance officer, and when do you need one?

Every business subject to AML obligations must appoint a compliance officer — but not every business can carry a full-time salary. This is the alternative.

An outsourced compliance officer is a certified specialist who takes on the compliance officer role in your business under a service agreement rather than on your payroll. The role and the responsibilities are the same; the contractual arrangement simply suits businesses whose size does not justify a dedicated hire.

Why is a compliance officer required at all?

Businesses subject to AML obligations in the UAE are required to have someone responsible for monitoring activity, applying due-diligence procedures and filing reports when the grounds arise. Having that person is not optional, and their absence is itself a regulatory finding.

What does an outsourced compliance officer actually do?

  • Builds the compliance framework, or reviews the existing one and closes its gaps
  • Applies customer and beneficial-owner screening procedures
  • Monitors activity and flags patterns that warrant investigation
  • Prepares periodic reports and tracks reporting obligations
  • Keeps records in a way that leaves the business ready for inspection

When does your business need this?

If your activity falls within the categories in scope — real estate brokerage, dealing in precious metals and stones, company formation services, or accounting and audit firms — the full framework is required of you regardless of your size. The difference is that large businesses hire, while small and mid-sized ones engage an outsourced compliance officer.

It also suits businesses that have suddenly lost their compliance officer, or received regulatory findings that need fast, experienced remediation.

How does it differ from an in-house officer?

The difference is contractual, not one of responsibility. An in-house officer is dedicated to one business, and their experience is limited to what has passed through it. An outsourced compliance officer brings experience accumulated across several businesses and sectors, costs a fraction of a full-time salary, and does not stop when someone takes leave or resigns.

How do you start?

Start with an honest assessment of where you stand: is your registration complete? Do you have a documented risk assessment? Are your policies written and actually applied? That assessment sets the size of the gap and the order of remediation before any commitment.
